Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website, mobile application, and related services (collectively, the “Platform”) operated by BudOnTheRun (“we,” “us,” or “our”), operating under the trade name BudOnTheRun (BudRun), available at budontherun.com. Please read these Terms carefully before using the Platform.

By accessing or using the Platform, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

1. About BudOnTheRun (BudRun)

BudOnTheRun (BudRun) is a cannabis delivery marketplace that connects customers with licensed, independently operated cannabis dispensaries across Canada. BudOnTheRun (BudRun) does not sell, distribute, grow, process, or otherwise handle cannabis products. We are a technology platform that facilitates transactions and communications between customers and dispensary partners.

All cannabis products available through the Platform are sold and fulfilled by independent, licensed dispensary partners. BudOnTheRun (BudRun) is not a licensed cannabis retailer.

2. Eligibility and Age Requirement

To use the Platform, you must:

Be at least 19 years of age, or the minimum legal age required in your province or territory, whichever is higher;
Be a resident of Canada in a province or territory where cannabis delivery is permitted by applicable law;
Have the legal capacity to enter into a binding agreement; and
Not be prohibited from using the Platform under any applicable law.

By registering an account or using the Platform, you represent and warrant that you meet all eligibility requirements. BudOnTheRun (BudRun) reserves the right to request proof of age or identity at any time and to terminate any account found to be in violation of these requirements. It is your sole responsibility to ensure that cannabis delivery is legal in your municipality, city, or province before placing an order.

3. User Accounts

To access certain features of the Platform, you must register for an account. When registering, you agree to:

Provide accurate, complete, and up-to-date information;
Maintain the confidentiality of your account credentials and not share your password with any third party;
Notify us immediately at support@budontherun.com if you suspect unauthorized access to your account; and
Be responsible for all activity that occurs under your account.

BudOnTheRun (BudRun) reserves the right to suspend or permanently terminate any account that violates these Terms, engages in fraudulent or illegal activity, or otherwise poses a risk to the Platform, other users, or dispensary partners.

4. Orders and Delivery

Orders placed through the Platform are subject to the following terms:

Orders are received and fulfilled by independent, licensed dispensary partners — not by BudOnTheRun (BudRun);
BudOnTheRun (BudRun) acts solely as a marketplace intermediary and does not sell cannabis directly;
Delivery times, delivery fees, minimum order amounts, and delivery zones are set by individual dispensaries and are subject to change;
Orders are subject to product availability and dispensary operating hours at the time the order is placed;
A dispensary may cancel or modify an order if a product is unavailable or if there is an error in the listing — you will be notified if this occurs;
BudOnTheRun (BudRun) is not responsible for delays, errors, product quality issues, or other problems arising from individual dispensary operations; and
Delivery of cannabis products is subject to applicable provincial and federal law, including age verification requirements upon delivery.

By placing an order, you consent to provide valid government-issued photo identification to the delivery driver upon receipt of your order, as required by applicable cannabis regulations.

5. Payments

Payment methods accepted on the Platform include credit and debit card payments (processed securely via our third-party payment processor, Stripe) and Interac e-Transfer, subject to availability as determined by individual dispensaries.

BudOnTheRun (BudRun) does not store full payment card numbers. Card transactions are handled entirely by Stripe in accordance with their terms and privacy policy.
All prices displayed on the Platform are in Canadian dollars (CAD) unless otherwise indicated.
Prices are set by individual dispensaries and are subject to change without notice.
Any applicable taxes are the responsibility of the dispensary partner and will be reflected in the order total where required by law.

6. Dispensary Partners

Dispensaries listed on the Platform are independent businesses that have agreed to our Dispensary Partner Terms. They are solely responsible for:

The accuracy of their product listings, including descriptions, pricing, and availability;
Their operating hours and delivery zones;
Compliance with all applicable cannabis retail and delivery laws and regulations;
The quality and safety of cannabis products they sell and deliver; and
Age verification of customers upon delivery.

BudOnTheRun (BudRun) does not guarantee the accuracy of any dispensary-provided information and is not responsible for dispensary errors, product defects, or regulatory non-compliance by dispensary partners.

7. Platform Fees and Subscriptions

7.1 Customer Use

Use of the BudOnTheRun (BudRun) Platform is free for customers. There are no registration fees, subscription fees, or commissions charged to customers for browsing or placing orders.

7.2 Dispensary Plans

Dispensary partners may register and list on the Platform at no cost under the Basic plan. Optional paid plans are available and provide access to additional tools and features:

Standard Plan: Available at the current advertised monthly rate. Includes an increased product limit, store photos, product images, discount coupons, and custom store badges.
Pro Plan: Available at the current advertised monthly or annual rate. Includes unlimited products, live chat, product import, priority support, and additional features.

Plan pricing, features, and availability are as displayed in the dispensary dashboard and on the BudOnTheRun (BudRun) website at the time of subscription. Introductory pricing, where offered, is locked in for the life of the subscription for qualifying members who subscribe during the introductory period.

7.3 Featured Listing Add-on

Dispensaries on any plan may purchase a Featured Listing add-on, which provides premium placement at the top of the BudOnTheRun (BudRun) marketplace and map. Featured Listings are subject to the following terms:

Featured Listings are available at $29.00 CAD per month or $279.00 CAD per year;
Payment is processed via Stripe (credit/debit card) or by Interac e-Transfer as directed in the dispensary dashboard;
Featured status is activated upon confirmation and successful processing of payment;
Featured Listing fees are non-refundable once the billing period has commenced;
BudOnTheRun (BudRun) reserves the right to adjust Featured Listing pricing with reasonable advance notice to active subscribers; and
Dispensaries must remain in good standing under these Terms to maintain a Featured Listing. BudOnTheRun (BudRun) reserves the right to remove a Featured Listing from a dispensary that violates these Terms.

7.4 Subscription Cancellations and Refunds

Paid subscriptions may be cancelled at any time by contacting us at support@budontherun.com. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

8. Prohibited Conduct

You agree not to use the Platform to:

Purchase, attempt to purchase, or facilitate the purchase of cannabis if you are under the applicable minimum legal age;
Provide false, inaccurate, or misleading information at any point, including during registration, ordering, or age verification;
Use the Platform for any unlawful purpose or in violation of any applicable federal, provincial, or municipal law or regulation;
Resell, redistribute, or transfer cannabis products purchased through the Platform;
Interfere with, disrupt, or attempt to gain unauthorized access to the Platform or its related systems;
Use automated tools, bots, scrapers, or scripts to access or extract data from the Platform without our written consent;
Post, upload, or transmit any content that is defamatory, obscene, threatening, or otherwise objectionable;
Engage in any conduct that could damage the reputation or operations of BudOnTheRun (BudRun) or any dispensary partner; or
Circumvent or attempt to circumvent any security or access control measures on the Platform.

Violation of these prohibitions may result in immediate account suspension or termination and may be reported to applicable law enforcement authorities.

9. Reviews and User Content

The Platform may allow you to submit reviews, ratings, and other content (“User Content”). By submitting User Content, you grant BudOnTheRun (BudRun) a non-exclusive, royalty-free, perpetual, and worldwide licence to use, display, reproduce, and distribute such content on the Platform. You represent that your User Content is accurate, does not infringe any third-party rights, and complies with these Terms.

BudOnTheRun (BudRun) reserves the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be inappropriate, false, or harmful.

10. Intellectual Property

All content on the Platform, including but not limited to logos, text, graphics, user interface design, software, and trade names (including “BudOnTheRun” and “BudRun”), is the property of BudOnTheRun (BudRun) or its licensors and is protected by applicable Canadian intellectual property laws, including the Copyright Act and the Trademarks Act.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content on the Platform without our prior written permission. Nothing in these Terms grants you any licence to use our intellectual property.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate third-party services (such as mapping providers, payment processors, and analytics tools). These third-party services are governed by their own terms and privacy policies. BudOnTheRun (BudRun) does not endorse and is not responsible for the content, practices, or availability of any third-party websites or services.

12. Disclaimers

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, BudOnTheRun (BudRun) disclaims all warranties, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, and non-infringement;
Any warranty that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components; and
Any warranty regarding the accuracy, completeness, or reliability of dispensary listings, product information, or delivery estimates.

13. Limitation of Liability

To the fullest extent permitted by applicable law, BudOnTheRun (BudRun), its officers, directors, employees, contractors, agents, affiliates, and licensors shall not be liable for any damages of any kind — whether direct, indirect, incidental, special, consequential, punitive, or exemplary — arising out of or in any way connected with your use of, or inability to use, the Platform.

Without limiting the generality of the foregoing, BudOnTheRun (BudRun) expressly disclaims all liability for:

The acts, omissions, errors, representations, or conduct of any dispensary partner, delivery driver, or third party;
The quality, safety, accuracy, legality, or fitness for purpose of any cannabis product listed or sold through the Platform;
Incorrect product descriptions, pricing errors, or unavailability of products;
Delivery delays, failed deliveries, lost orders, or disputes between you and a dispensary;
Any interruption, suspension, slowdown, or discontinuation of the Platform, whether planned or unplanned;
Data loss, corruption, or unauthorized access to your account or personal information;
Bugs, viruses, or other harmful code transmitted through the Platform by third parties;
Any transaction or communication between you and a dispensary partner, whether through the Platform or otherwise;
Any failure by a dispensary to honour an order, refund, or commitment made through the Platform;
Any regulatory action, fine, or legal consequence resulting from your use of the Platform or purchase of cannabis products; or
Any other matter beyond BudOnTheRun (BudRun)’s reasonable control.

BudOnTheRun (BudRun) is a technology intermediary only. We are not a party to any transaction between you and a dispensary partner. All disputes regarding orders, products, delivery, or payments must be resolved directly between you and the relevant dispensary. BudOnTheRun (BudRun) has no obligation to mediate, intervene in, or resolve any such dispute.

14. Indemnification

You agree to indemnify, defend, and hold harmless BudOnTheRun (BudRun), its officers, directors, employees, agents, and dispensary partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit to the Platform.

15. Modifications to the Platform and Terms

BudOnTheRun (BudRun) reserves the right to modify, suspend, or discontinue the Platform or any feature thereof at any time, with or without notice. We also reserve the right to update these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or through the Platform.

Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

16. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be attempted to be resolved informally by contacting us at legal@budontherun.com. If the dispute cannot be resolved informally within thirty (30) days, the parties agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario.

17. General

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BudOnTheRun (BudRun) with respect to the Platform and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it in the future.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
Language: These Terms are written in English. To the extent required by applicable law in the Province of Quebec, a French version will be made available upon request.
